Privacy Notice

In order to guarantee and safeguard your right to privacy and informational self-determination, and in accordance with the privacy policies of Delta Exponential Technologies S.A. de C.V. ("Delta"), as well as with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, published in the Official Gazette of the Federation on March 20, 2025 ("LFPDP") this Privacy Notice is issued:

IDENTITY AND ADDRESS OF THE DATA CONTROLLER

Delta, with registered address at Calle Fuente de la Luna No. 131, Col. Fuentes del Pedregal, Tlalpan, 14140, Mexico City, Mexico, is responsible for the collection, use, disclosure, and storage of personal data (hereinafter "`Data Processing"), under the terms of the LFPDP.

PERSONAL DATA AND HOW IT IS COLLECTED

Delta will require personal data when you request information and/or contract any of our services, whether as a client, subscriber, potential client, or company, in person, through electronic means, or by any other source permitted by law.

The personal data that may be requested from you will be those necessary for the proper provision of our services within the United Mexican States ("Mexico") and/or abroad. 

You understand and agree that your personal data may be processed directly or indirectly by third parties, whether they are suppliers, service providers, or external professional advisors acting jointly with Delta or at Delta's request, when such processing by third parties is necessary for Delta to provide or perform the services you have requested and to fully fulfill its obligations as a provider of such services. Additionally, Delta may provide the information you require to competent authorities when requested to do so.

Should Delta share your personal data with third parties, Delta will ensure that such third parties take the necessary measures to protect the confidentiality and security of your personal data. Furthermore, such third parties will be required to comply with Delta's privacy and confidentiality policies, this Privacy Notice, and applicable legal provisions.

Delta will not request data classified as sensitive as defined in Article 2, section VI.

The personal data that may be collected includes, but is not limited to, the following:

  • Personal and business contact information (name, company name, address, email address, phone number, or fax number);
  • Information that allows us to verify your identity such as date and place of birth, nationality, marital status, home address, etc.;
  • Names, email addresses, and phone numbers of other individuals whom we are asked to send information to or contact;
  • Information regarding your participation in civil and commercial companies, any real rights you may hold, tax matters, and any other information related to your legal and business situation;
  • Payment information (including credit card information or online payment service number and address) and financial information, such as bank account number; and
  • Additionally, when you visit our website, we may collect certain information by automated means, such as cookies and web beacons. The information we collect in this manner includes: IP address, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken on our site, and dates and times of website visits. A "cookie" is a text file that websites send to visitors' computers or other Internet-connected devices to uniquely identify the visitor's browser or to store information or settings in the browser. A "web beacon, also known as an Internet tag, single-pixel tag, or clear GIF, links web pages to web servers and their cookies and can be used to transmit information collected via cookies to the web server. Through these automatic collection methods, we obtain clickstream data (clickstream data), which is a record of the content a visitor clicks on while browsing a website. As the visitor clicks through the website, a record of their actions may be collected and stored. We may link some of the data elements we collect through these automatic methods, such as your browser information, with other information obtained about you in order to determine, for example, if you have opened an email we sent you. We may also use third-party website analytics tools to collect information about visitor traffic on our websites. Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. However, please note that without cookies, you may not be able to use all the features of our website.

Delta will store your personal data exclusively for the purposes described in this Privacy Notice, and for as long as necessary in accordance with applicable legal provisions.

PURPOSE AND DATA PROCESSING

Delta is committed to preserving the information of its clients, subscribers, potential clients, companies, and suppliers in complete privacy, which is why we have adopted the necessary administrative, technical, and physical security measures to protect your personal data against loss, alteration, destruction, and unauthorized access.

Access to personal data held by Delta will be limited to individuals who need access to such information for the purpose of fulfilling the objectives identified in this Privacy Notice.

Delta will use the information collected for the following purposes:  

  • Identification of the client, supplier, or employee, for them to contract with Delta.
  • The provision of cybersecurity and compliance services;
  • Customer follow-up
  • Satisfaction surveys
  • Statistical analysis
  • Marketing, advertising, and commercial prospecting
  • To maintain a database;
  • To communicate with you and respond to your questions and/or comments;
  • To identify our clients in accordance with the provisions of the Federal Law for the Prevention and Identification of Operations with Illicitly Sourced Funds;
  • To process and collect payments; and
  • To comply with applicable legal requirements and our policies

When you use our website, data is stored on our servers for preventive purposes, such as the websites you visit from our site and your IP address. While this data could potentially lead to your identification, it is not used for this purpose. The data is used for statistical purposes, so the individual user remains anonymous.

The consent of the personal data subject is granted either in writing, by electronic signature, or by accepting this Privacy Notice.

CONSENT

You must grant Delta your consent for the processing of your personal data, which Delta will consider granted if, after this privacy notice has been made available to you, you do not express your opposition within a period of 5 days, in accordance with Articles 15, 16, and 17 of the LFPDP and other applicable provisions.

For all relevant purposes, Delta states that your personal data will not be processed for purposes other than those necessary for and arising from the relationship between you, as the data subject, and Delta as the service provider.

Should you require the limitation of the use or disclosure of your personal data, please inform us via the email address provided below, stating the reason or motive for such limitation

MECHANISMS, MEANS, AND PROCEDURES FOR EXERCISING ARCO RIGHTS

In accordance with Chapters III and IV of the LFPDP, you have the right to exercise your rights of access, rectification, cancellation, and opposition (the “ARCO Rights”) as follows:

You have the right to access your personal data that we hold and the details of its processing, as well as to rectify it if it is inaccurate or incomplete; to cancel it when you consider that it is not required for any of the purposes indicated in this Privacy Notice, is being used for non-consented purposes, or the contractual or service relationship has ended; or to object to its processing for specific purposes, except in cases indicated in applicable legal provisions.

To exercise your ARCO Rights, you, as the data subject, or your legal representative, must send a written request specifying your requirements, via email or courier to the following addresses:

The written request to exercise ARCO Rights must be personally signed by you, the data subject, or your legal representative. If you or your representative are unable to sign, a fingerprint must be provided. This request must be accompanied by an official identification of the data subject or their legal representative, as well as documentation proving the legal representative's authority.

Likewise, should you wish to revoke your consent for Delta to process your personal data, you must submit a written request as previously indicated, stating your revocation of consent.

PROCEDURE AND MEANS OF INFORMATION REGARDING CHANGES TO THE PRIVACY NOTICE

Delta reserves the right to make modifications or updates to this Privacy Notice at any time, as well as to its privacy policies, to address new legislation, internal policies, or new requirements for the provision or offering of our services or products, among others. These modifications will be made available to the public through the following means: (i) visible announcements in our establishments or customer service centers; (ii) on our website https://www.deltaprotect.com/

If there are any changes or modifications to this Privacy Notice, the updated version will be made available to you through the aforementioned channels. Failure to object to the modified Privacy Notice within 5 days of it being made available will be understood as acceptance and consent to the terms established therein, in accordance with Article 26 of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDP), with the understanding that these policy changes will always comply with current Mexican legislation (please check our privacy notices frequently to stay informed of such changes, if any).
